Anglophones, help me out: is it "the last free compartment ON the train" or "the last free compartment IN the train"?

Follow-up question: what do you call it when someone holds up both hands, empty palms facing outwards, to about shoulder level in an imitation of a surrender to signify compliance and peaceful intent in an argument (not a physical fight), such as after being told to shut up and stop being a cunt? Often accompanied by a faux-innocent, exasperated, or exaggerated "who, me?" expression.
